1. Who we are
LekkerGuest is operated by Just Be Lekker Inc., trading as LekkerGuest ("LekkerGuest", "we", "us", "our"), 2035 Sunset Lake Road, Suite B-2, Newark, Delaware, 19702, US. LekkerGuest provides guest verification, damage protection facilitation, and claims processing technology for short-term rental hosts. Questions about these Terms: hello@lekkerguest.com.
2. Definitions
"Host": an accommodation provider with a LekkerGuest account who configures Protection for their properties.
"Guest": a person who completes, or is invited to complete, Pre-Check-In for a Booking at a Host's property.
"Booking": a reservation at a Host's property to which the Services are applied.
"Pre-Check-In": the process by which a Guest verifies their identity, provides required information, signs the Host's house rules or terms, and confirms Protection before check-in.
"Protection": the Security Deposit and/or Damage Waiver configured by the Host for a Booking.
"Security Deposit": a refundable card authorisation (hold) placed on the Guest's payment card for an amount set by the Host. A hold is not a charge.
"Damage Waiver": a non-refundable fee set by the Host which limits the Guest's liability for accidental damage designated as covered by the Host, up to the cover amount set by the Host.
"Claim": an itemised incident report lodged by a Host for damage, fines, or fees arising from a Booking.
"LekkerGuest Score": the aggregate guest rating derived from Host reviews of verified stays.
"Services" or "Platform": the LekkerGuest website, applications, and related services.
3. Acceptance and changes
Hosts accept these Terms when creating an account. Guests accept these Terms when completing Pre-Check-In. If you do not agree with these Terms, you must not use the Services. We may update these Terms from time to time; material changes will be notified by email or in the Platform before they take effect, and the current version will always be available on the Platform. Continued use after the effective date constitutes acceptance.
4. What LekkerGuest is, and what it is not
LekkerGuest is a technology platform. We verify Guests, collect and hold Protection, and process Claims and settlements on the Host's behalf and at the Host's instruction.
LekkerGuest is not an insurer, and nothing on the Platform is an insurance product. Protection terms are set by the Host, and the Host bears the risk and benefit of those terms. Damage Waiver amounts collected belong to the Host.
LekkerGuest is not a party to the accommodation agreement between Host and Guest. The Host's own booking or rental terms and house rules govern the stay itself.
LekkerGuest does not guarantee payment of any Claim, the conduct of any Guest, or the condition of any property.
5. Host terms
5.1 Accounts
Hosts must provide accurate account and business information and have authority to bind the organisation they register. Hosts are responsible for activity under their account.
5.2 Configuring Protection
Hosts may configure, per property, a Security Deposit, a Damage Waiver, or both as options presented to the Guest. Amounts must be reasonable, lawful, and consistent with the Host's booking terms and applicable consumer law.
5.3 Fees
Damage Waiver collections: LekkerGuest deducts a 15% service fee from each Damage Waiver fee collected; the Host receives the remaining 85%.
Claims: a 15% service fee is calculated on the total charge amount and added on top of the approved Claim amount, payable by the Guest. The Host receives the full approved Claim amount.
Security Deposit verification: a service fee of USD 2.50 (converted to the Booking currency) is charged to the Guest for each verified Security Deposit Booking, at no cost to the Host.
Fee rates may change on reasonable prior notice; changes apply to Bookings verified after the effective date.
5.4 Payouts
Payouts are made to the Host's connected Stripe account. Hosts must maintain a valid payout account and provide information Stripe requires. Where payout currency differs from the charge currency, Stripe currency conversion applies; conversion costs range from 1%–2% of the total transfer value.
5.5 Claims conduct
Hosts must lodge Claims honestly, itemised, and supported by evidence, and as soon as reasonably possible after check-out while the Protection remains in place. Fraudulent or inflated Claims, or misuse of the review system, may result in Claim rejection, suspension, or termination.
5.6 Reviews
Host reviews of Guests must be factual, fair, and related to verified stays. LekkerGuest may moderate, withhold, or remove reviews that breach these Terms.
6. Guest terms
6.1 Pre-Check-In
Guests must complete Pre-Check-In before check-in: identity verification (including providing a copy of an identity document), required contact details, any property access forms, signature of the Host's house rules or terms, and confirmation of Protection with a valid payment card. Failure to complete Pre-Check-In may result in refusal of access to the property under the Host's booking terms, without refund by the Host.
Uploaded identity documents may be processed by an automated system (a third-party AI provider) to perform a data-quality check comparing the ID number you entered to the number visible on your document. This is not identity verification; results are used by Hosts as a review signal only and do not replace the Host's check-in confirmation.
6.2 Guest accounts
A Guest profile keyed to your verified identity is created on first verification and reused for future LekkerGuest stays. Payment methods are stored securely by our payment processor, Stripe; LekkerGuest does not store card numbers.
6.3 Option 1: Refundable Security Deposit
A hold is placed on your card for the deposit amount set by the Host 1 day before check-in. A hold is an authorisation, not a charge.
A non-refundable service fee of USD 2.50 (converted to the Booking currency) is charged when your Security Deposit Booking is verified.
If no Claim is lodged, the hold is released automatically after check-out. Banks may take 3 to 12 business days to reflect the release.
Amounts may only be captured from the hold pursuant to a Claim under section 7.
If the hold cannot be authorised, you will be notified and must provide an alternative card. If no hold can be placed before check-in, the Host may refuse access or cancel under the Host's booking terms.
6.4 Option 2: Non-Refundable Damage Waiver
The Damage Waiver fee is set by the Host, is non-refundable, and is collected at Pre-Check-In.
The Damage Waiver limits your liability for accidental damage to items the Host has designated as covered, up to the cover amount set by the Host.
The Damage Waiver does not cover: damage to items designated as not covered; damage caused by malicious, reckless, or negligent behaviour; breaches of house rules; or fines and penalties. Such amounts, and any accidental damage exceeding the cover amount, remain payable by you and may be claimed under section 7.
6.5 Payment authorisation
By completing Pre-Check-In you authorise LekkerGuest to place holds, collect the fees described in these Terms, and capture amounts due under a Claim resolved in accordance with section 7, using your provided or stored payment method.
7. Claims and disputes
If damage, fines, or fees arise from your stay, the Host may lodge an itemised Claim with supporting evidence. You will be notified by email.
You have 72 hours from notification to review the Claim and either accept it or dispute specific items with your own evidence, through the Platform.
If you do not respond within 72 hours, the Claim proceeds as lodged and the settlement amount may be captured.
Disputed items are resolved through the Platform's dispute process; only the resolved amount is captured.
A 15% service fee on the total charge amount is added to the Claim settlement and is payable by the Guest.
Where the settled amount exceeds the Protection in place, the balance remains payable by the Guest and may be collected via the payment options presented (including Pay Now), or charged to your stored payment method where authorised.
Initiating a bank chargeback in bad faith against amounts properly settled under this section is a breach of these Terms and may result in account suspension and recovery of costs.
8. Reviews and the LekkerGuest Score
By using the Platform, Guests acknowledge and agree that:
- Hosts may review and rate Guests after a stay, based on behaviour, adherence to property rules, and conduct.
- Reviews and ratings are linked to your verified identity and are made available to Hosts within the LekkerGuest network, in anonymised host attribution, as part of guest screening. Hosts may use them when accepting or declining Bookings.
- Individual reviews are not published to Guests. Guests can see their aggregate LekkerGuest Score in their account once they have completed three or more stays, and may at any time request a full copy of the information LekkerGuest holds about them, as described in the Privacy Notice.
- Review data is processed in accordance with the Privacy Notice and applicable law, including POPIA.
9. Payments processing
Payments, holds, and payouts are processed by Stripe. LekkerGuest does not store full card numbers. Charges are presented in the Booking currency; your bank may apply its own fees or conversion. Where LekkerGuest or Stripe converts currency, the applicable rate and costs are shown on the relevant transaction record.
10. Privacy
Personal information is processed as described in the LekkerGuest Privacy Notice. The Privacy Notice explains what we collect (including identity documents and review data), why, who sees it, and your rights under POPIA, including access, correction, and deletion.
11. Intellectual property
The Platform, its content, and the LekkerGuest brand are owned by LekkerGuest and/or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Platform for its intended purpose. You may not copy, republish, sell, or redistribute Platform material without written permission.
12. Acceptable use
You must not: use the Services unlawfully; provide false identity or payment information; interfere with the Platform's operation or security; attempt to circumvent verification, Protection, or fees; or use Platform data (including reviews) outside the purposes these Terms allow.
13. Liability
The Services are provided "as is" and "as available". LekkerGuest is not liable for the conduct of Hosts or Guests, the condition or safety of any property, or the accommodation agreement between Host and Guest. To the fullest extent permitted by applicable law, LekkerGuest is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, goodwill, or data. LekkerGuest's total aggregate liability arising out of or relating to the Services is limited to the greater of (a) the total service fees paid to LekkerGuest by, or in respect of, the claiming party in the 12 months preceding the event giving rise to the claim, and (b) R10,000. Nothing in this section 13 excludes or limits: (a) LekkerGuest's obligation to release, pay over, or account for amounts it has collected or holds on your behalf, including deposit hold releases, Claim settlements, and Host payouts; (b) liability arising from fraud or wilful misconduct; (c) liability for gross negligence, to the extent the Consumer Protection Act or other applicable law prohibits its exclusion; or (d) any other liability that cannot lawfully be excluded or limited.
14. Suspension and termination
We may suspend or terminate access for breach of these Terms, fraud, or misuse, and will act reasonably and proportionately in doing so. Hosts may close their account at any time; accrued obligations (including open Claims, holds, and payouts) survive until resolved. Sections which by their nature should survive termination do so.
15. General
Governing law and jurisdiction: these Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws of the State of Delaware, United States of America, and the parties submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware. This does not deprive you of any protection granted by provisions that cannot be derogated from by agreement under the law of your country of residence, including, for South African consumers, the Consumer Protection Act and POPIA, and does not prevent either party from seeking interdictory or equivalent urgent relief in any court of competent jurisdiction.
If any provision is found unenforceable, the remainder continues in force.
These Terms, together with the Privacy Notice and any Host booking terms presented at Pre-Check-In, are the entire agreement between you and LekkerGuest for the Services.
We may assign these Terms as part of a corporate reorganisation; you may not assign them without our consent.
